Petroleum and Energy Authority mandate

The Petroleum and Energy Authority established with the new Ethiopian federal government establishment proclamation 1263/2021 as petroleum sector and energy sector regulatory body.

 The Authority has the following powers and duties;

  1. Formulate comprehensive legal framework for the petroleum and energy sector, submit to the appropriate organ for approval and Implement upon,
  2. Undertake capacity building activities in the petroleum and energy sector,
  3. Issue, regulate, renew, suspend, replace and revoke professional certificate and business license for a person engaged in the energy sector and impose an administrative penalty,   
  4. Issue, renew, replace, suspend and revoke competency certificate to a person engaged in petroleum and energy sector and impose administrative penalty,
  5. Review national grid related tariff submitted to it by a licensee and submit its recommendation to Council of Ministers for approval and upon approval, regulate its implementation thereof; issue and regulate the implementation of directives for the determination of off-grid tariffs,
  6. Prepare and submit to the ministry petroleum products wholesale and retail prices and profit margin determination directives and implement upon its approval by the concerned organ.
  7. Prepare and submit to the Ministry petroleum products wholesale and retail prices and profit margin of market participants proposal and implement upon approval by concerned organ,
  8. Prepare long-term, medium-term and short-term energy efficiency and conservation strategy and program at the National and sartorial levels and on the basis of periodic reports to be submitted to it, evaluate the implementation of same,
  9. Promote and coordinate energy efficiency and conservation research, demonstration centers, technology transfer. Cooperate and work with regional and international training and capacity building institutions and promote efficient use culture,
  10. Issue energy audit code, energy efficiency standards code, energy efficiency labeling code, national grid code, customers service code, technical inspection code, service quality standard code, building electrical installation code, technical standard code, and other codes and supervise the implementation of same,
  11. Ensure that the regulatory systems and procedures of the petroleum and energy sectors are supported by modern technology, deploy, cause the deployment of technology infrastructure and regulate its implementation,
  12. Approve power purchase and electrical network service agreements,
  13. Establish laboratories for petroleum and energy efficiency testing and issue and implement testing procedures,
  14. Collect, organize, analyze and disseminate data related to petroleum and energy supply, distribution, and utilization;
  15. Collect income of the energy efficiency and conservation fund,
  16. Set procedures supported by modern technology to regulate accessible and fair distribution of petroleum products and follow-up and regulate its implementation,
  17. Cause the setting of mandatory Ethiopian standard for petroleum products in consultation with appropriate body, follow up the implementation same,
  18. In collaboration with pertinent bodies, determine the required volume of petroleum reserve, make sure that the reserve is maintained, follow-up whether there is sufficient supply of petroleum products in the market, propose solution to any problem observed in relation with the supply of petroleum products in the market and follow up the implementation thereof,
  19. In Collaboration with appropriate organs support the development of market and logistics infrastructure in the energy and petroleum sector,
  20. Review the request submitted to it by those institutions to purchase petroleum products directly from oil companies in bulk for self-use and grant permission,
  21. Ensure the newly constructed petroleum products retail stations and depots meet the requirement to start operation,
  22. When disputes arise among those working in the energy and petroleum sector regarding their legal relationship and if the parties prefer to put a request to the Authority for its resolution, the Authority shall coordinate the resolution of the dispute in accordance with the Arbitration proclamation;
  23. The Authority as may be necessary shall establish professional panels to mediate or arbitrate a dispute claimed from licensee or customers pertaining conditions of supply of electricity, tariff or quality of services, issue and approve Directives.
  24. Collect service fee based on the rate set by the council of Ministers regulation,
  25. Follows-up the implementation of the rights and obligations of service providers and consumers in the sector, take appropriate corrective measures wherever gaps are observed,
  26. Own property, enter into contracts, sue and be sued in its own name;
  27. Perform other activities to achieving its stated objectives
